The Anchorage, Part 3

You know Rae, many years ago, lawyers, and those who worked for them, were automatically excused. Then they decided they needed more folks in the available pool of potential jurists, and now anyone can be called.

Though I would think any lawyer in the middle of a trial in another court would be excused, or at least postponed.

I have been called, literally, every two years like clockwork, since I turned 18. Seriously.

I had several times where I requested, and was granted, a temporary exclusion (I was the sole caregiver for my Chuck for five years... and he was round the clock care for the last two years), but they called me right back up the very second they could legally do so.

I have served on both city and state juries. One employer played so many games about my being selected that, no joke, the offices in Syracuse got ahold of them (my employer) and basically said "What do you people think you're DOING up there?" Among other things, I was told by my immediate supervisor that I was required to find my own coverage (yes that was standing policy at that facility), and that since the jury duty was during day shift, I was still expected to show up and work a full night shift... they didn't like being told that they were not legally allowed to do that.

The jury duty itself wasn't bad. It's just that I seriously get called at EVERY two year mark. They don't miss even ONE. At least nowadays I don't have to fight with a nursing home facility's HR department the next time it comes. ;)

Meanwhile, my Bear has only ever been called twice in our entire marriage... and both times his number was never asked to show up. He did his calls into the system to see if his number was being called in, and it wasn't, and that's considered to have fulfilled his requirements. So he's never actually had to serve. Me? I get picked every single time I go in there, and I get called EVERY single two years. In fact the last time they called me, I had to send them a copy of the certificate from the state jury duty, because that is supposed to exempt you for four years. I'm just about due now for another one! LOL

I would think if lawyers or other court officials are actively in the middle of a trial or something that they would be granted a postponement, yeah. I can't see how they could feasibly ask those folks to show up for jury duty if they're supposed to be in another courtroom under another judge...

Wow, every 2 years??? I've never been called more often than 4 years for regular Petite Jury duty, and it's 8 years for Grand Jury duty, though it was 10 years by the time they called me 1 1/2 years ago.

I still think when you're well into your "golden years", you should be exempt. Nooooo, you have to practically be on your deathbed to get excused. New York is SUCH a wonderful state to live in. ~shakes head~

Yes, every single two years I get called up. It's nuts. And then I know people around me who either have NEVER been called up even once, or they've been called up maybe ONCE in the last ten years. Got to love the "random lottery" effect, huh?

And yeah, I really think elders should be exempt - or at least have the option to ask for exemption if they're not in good health... but yeah, New York State and all that. LOL

In Philadelphia it's every year ... 1 day or 1 trial. Although, some people never ever get a summons. But if you're ever summoned, you can pretty much count on being summoned every year thereafter.

One of the first years, it was a trial that was going to last several weeks. I was excused when I explained I was the only developer and it would be a hardship for my company. A couple years later when we were asked if anyone had a hardship because this trial was going to last weeks, several of us asked to be excused because of work. This time, we were told work was not an acceptable reason to be excused. It was up to your employer to get a replacement or we'd just have to work evenings/weekends. Needless to say, I didn't appreciate that. Fortunately, I was not selected for the jury.

Last year, about an hour or so before we would be excused for the day, they needed a second panel because they hadn't filled the jury with the first panel of 60+ people. Of course, my name got called for the second panel. Turned out, it was a drug company that was being sued, and they expected the trial to last months. The drug company had a dozen or so lawyers, and by the end of the day, still had not filled the jury. So, we had to come back the next day while they continued jury selection.

I was finally excused late in the afternoon when they finally interviewed me. When I was asked if I could follow the judge's instructions, I said no. Should have seen the shock on their faces. Of course, they asked why not. I explained I can't always hear what people are saying, and if I couldn't hear what the judge said, I couldn't follow his instructions. I wasn't lying. Though it's not that I can't hear, I just can't separate what's being said from any background noise.

For the two days we sat in the courtroom, the guy next to me kept talking to me. But, I could only get scattered words here and there because of the conversations around me. Really not fun. Unlike most people my age, I can't blame it on rock concerts. In my case, it was numerous ear infections as a child and until I was in high school. After a serious infection in high school that I ignored for almost too long, I was finally tested for allergies. Turned out, I had mildew allergies.

During this entire process of waiting while people were interviewed, we sat on hard wooden benches. Of course, the chairs in the jury box were also hard wooden chairs! The more I looked at those chairs and the plush cushy chair the judge was sitting on, the more I got ... annoyed. How dare they expect us to sit on hard wooden chairs for hours and weeks. Bad enough the judge is making something like $163,897/year ... while the jurors get $9 a day. Oh yeah, along with a coupon for the local restaurants for like $1 off the cost of lunch. However, parking runs something like $22 a day.

I didn't mind jury duty when I lived in Oregon. I actually loved it. I was only summoned twice for Lane County jury duty from the time I turned 18 until I left Oregon at 40. In those days, Lane County jury duty was a week, and you weren't excused if you were on a trial that didn't last the entire week. But, seating was comfortable, both in the waiting area and in the jury box. Parking was covered by the county, and food was provided in the morning (fruit, donuts, muffins, etc.) Philadelphia had stopped doing that by the second year I was summoned, and all they had are vending machines.

I was actually rather shocked the first year I was called in Philadelphia. I was still registered to vote in Oregon, my car was registered in Oregon, and I still had an Oregon driver's license. Turns out, Philadelphia gets their list of names from everything.

Yikes, Satira. I do have to say that is one thing my area does right... seating is comfortable, and they do provide at least the drinks... when the judge in my last round discovered that most of us were not leaving the building to go get lunches on our lunch break, he asked us why.

Our lot was all lower income or middle income. We were losing a week of work, the paltry compensation they offer here doesn't even come close to making up the difference, tacked onto the parking fees or public bus fees if not driving, and frankly we not only couldn't afford to go buy a lunch from somewhere, but we were not bringing one either, in an attempt to limit how tight groceries would be the next week.

This judge did a round-count of all of us... only two people were not being severely impacted by the jury duty. He ordered lunch provided the rest of the week after that. But then, as I said... this is NYS, and this particular instance was state court.. the city and county courts in my area wouldn't haven given one whit about it, but the seating is at least comfortable, even there.

I would soooooooooo love to be excused permanently. Unfortunately, here in NY, there is NO upper age limit. :(
I can see that lack of a cut-off age being a problem. While there are plenty of elderly with sharp minds physical health becomes a serious issue. The older the person they draft the higher the percentage of people that will have problems complying.

I've been summoned several times here for District and once for Municipal. The first time was amusing as one of the men the pool was a high ranking person at the county jail so he always had to raise his hand when they asked if you knew the person etc. LOL

My employers have always included jury duty as a benefit, so I've never lost wages. My current employer requires that the check I receive for jury duty be turned over, but I don't remember if that's been the case for all my employers.

I don't really get employers who don't include sick days and jury days as a benefit. Better for all their employees and the sick employee if a sick employee stays home! As for jury duty, it's not exactly a volunteer thing. Not when failure to appear when summoned can result in being fined or jailed! I may not agree with all things Libertarian, but I do rather agree jury duty is a form of conscription.

Still, if conditions were different, I'd have a different attitude toward Philadelphia jury duty. I might even look forward to it. Like ... if parking were included and seating was comfortable. Though criminal cases in Philadelphia are kinda scary.

Spending hours in a huge room with a tv (or two) blaring on every wall stresses me out no end. I pay for monthly parking at a garage near work, so I'm not about to pay an additional $22 to park in a garage near the courthouse ... nor can I afford to. But since I slipped on ice during the winter and fell on my knee, I can't walk the 7+ blocks from the parking garage to the criminal justice center. The amount of walking during the day between the jury waiting room and the courtrooms would have my knee swollen by the end of the day. While my knee feels pretty good during the weekend and on Monday, each day it feels worse because of walking on pavement and unpadded carpet. By midweek, I'm hobbling :(

I also need more frequent potty breaks nowadays ... something that annoys me no end!

Our courts, especially the one closest to my house, and the one I've had to report to the past couple of decades, is a district court, and the jury box seats are individual padded swivel chairs, so they are comfortable. The gallery seating where you have to wait to be called, however, is hard wood, so not very comfortable. I don't think I've ever had to wait past the first round call for potential jurists to sit in the jury box, so I've never had to sit in the gallery for very long. Even the seating outside the courtroom have padded seats, so that's not too uncomfortable either.

As far as transportation, I don't know if there's public parking nearby, as most folks come by train (1/2 a block away), or bus (diagonally across the boulevard), and if it were a nice day, and I was in the mood, I could easily walk it. Granted it's about a 20 min. walk, but I've done it, in both directions, one day during lunch while serving on Grand Jury, because I had promised a gal I became friendly with a book I had finished reading, but forgot to bring with me that morning.

Afternoon everyone. Day two of nice sunny weather, turning to rain tonight. I have piles of nicely folded dry washing and just the sheets left to put out. Having a visit by my son tomorrow...we're going to go see the movie Warcraft tomorrow night. Shannon assures me I'm going to love it, I hope so, I'm paying!

Oh no, Miss B, I've been taught well by my offspring about spoilers ;) I do hope I like it, Shannon's been on a high about it since he first heard there would be a movie. You can guess where he got his geek from!

I never played it but went with 3 gamers (2 liked it the other was disappointed they didn't have big name actors).
I loved it, but its right up my ally :) (I did find some the acting could have been a little better, as I've seen the King in other things and he was pretty good so I think he might have been directed to be like that). Not giving anything away but in the game they have hippogriffs, in the movie they have griffins instead (OMG I want one just like it in my runtime!)

The Wicked Witch of the North
I've never even seen any of Warcraft games...Shannon had stopped his subscription by the time he started bringing his computer over here. And in March he was supposed to be coming over for a couple of days and resubscribed so he could take me through the world but I got a terrible case of the blue funks (just HATE IT when I get them, I mean, I love my bed but not that much :( ) and it never happened.

big plus you don't need to know anything about the games to enjoy it (only that what seems like days in the movie is months in the games)
