FYI -the Resource pack is going to be a completely separate product, not part of the base. It does include duf and mc6 files, so using those will make this a texture pack for end users as well as having the textures used as a MR.
Used as a Merchant Resourse, there will be specific requirements for using it - as Cath said, there will have to be changes made to it before it can be used as a commercial product for a vendor - exactly what is still being decided.
Both you AND whoever you hire would have to buy any products from HiveWire used in the creation of the pack.
By the way, this is ONLY going to be for commercial product use, not for freebies.

Here's an interesting question about merchant resources. Let's say I want to put tattoos on Dawn 2, but I'm a terrible painter or I just don't know how to do it. Can I, using a merchant resource, hire someone to do the custom tattoos for me? It seems like a rather straightforward question, but it also seems like I'd violate a EULA agreement somewhere down the line unless I paid for the merchant resource twice. Once for me, and once for the third party I'd have to hire. Or is that a mistaken belief?
